Terms and Conditions of Sale

1. Scope and Contracting Parties
These Terms and Conditions of Sale (the “Terms”) apply to all orders placed by consumers (private individuals) through the online store www.eclatsdemail.ch (the “Site”), operated by:

(the “Seller,” “we,” “us” or “our”). The customer is referred to as “you” or the “Customer.”
By placing an order, you expressly accept these Terms in their entirety, to the exclusion of any other terms.
2. Products
We offer fine handcrafted jewelry in precious metals (gold and/or silver) with Grand Feu enamel. Every piece is unique or produced in a very limited series.
Photographs and descriptions on the Site are provided for illustration purposes: slight variations in enamel color or reflections may occur.
Each piece comes with:
- a certificate of authenticity stating the metal, its fineness (for example 750/1000 for 18-karat gold), and the maker’s mark and/or fineness hallmark in accordance with Swiss law;
- a presentation box.
3. Prices
Prices are shown in the currency displayed on the Site for your delivery country.
For deliveries within Switzerland, displayed prices are final prices and include Swiss VAT at 8.1%.
Deliveries outside Switzerland are exempt from Swiss VAT. Import duties and taxes of the destination country are calculated and added at checkout (see Section 6).
We reserve the right to change our prices at any time. The applicable price is the one displayed when your order is confirmed.
4. Orders and Formation of Contract
The display of products on the Site does not constitute a binding offer. Your order constitutes an offer to purchase. The contract is formed upon receipt of our written order confirmation by email.
We reserve the right to decline an order, in particular in cases of suspected fraud, unavailability of stock, or a high-risk delivery address.
5. Payment
Payment is made securely using the methods shown on the Site, including credit card (via Shopify Payments) and PayPal.
Full payment is due immediately upon placing your order. Jewelry remains our property until payment has been received in full.
6. Shipping
Shipping is complimentary and fully insured worldwide, to all destinations offered on the Site. Carrier: DHL or FedEx, depending on the destination and the value of the shipment.
Estimated delivery times, from payment confirmation:
- pieces in stock: 5 to 10 business days;
- made-to-order pieces: 2 to 6 weeks, with the delivery date confirmed by email after your order.
If delivery is more than 30 days later than the estimated date, you may cancel your order and receive a full refund.
Your jewelry travels at our risk. Risk passes to you upon delivery of the parcel to you or to the person you have designated.
Import Duties and Taxes (outside Switzerland)
For deliveries outside Switzerland, import duties and taxes of the destination country are calculated and shown at checkout, on the “Taxes” line. You pay them together with your purchase: nothing more will be charged on delivery. Eclats d’Email SA handles customs clearance with the carrier.
7. Returns and Refunds
Swiss law does not provide a statutory right of withdrawal for distance contracts. We nevertheless offer you the option to return a piece within 14 calendar days of receipt, under the following conditions:
- the piece is in perfect, unworn condition, in its original presentation box, with its certificate of authenticity and proof of purchase;
- you have obtained our prior approval by email at info@eclatsdemail.ch.
Return shipping: once your return is approved, we will send you a prepaid, insured return label, at no cost to you.
Refunds: the price of the piece is refunded to your original payment method within 14 days of receipt and inspection of the return. Import duties and taxes paid at checkout are non-refundable.
Custom and personalized pieces: these cannot be returned or exchanged, except in the case of a defect.
8. Warranty, Care and Restoration
Our jewelry is covered by the Swiss statutory warranty for defects (Articles 197 et seq. of the Swiss Code of Obligations). Any defect must be reported to us as soon as it is discovered. The limitation period is 2 years from delivery.
Grand Feu enamel is a noble material, but it is sensitive to impact. Damage occurring after delivery (impact, dropping, abnormal wear) is not covered by the warranty. We offer an enamel and metal restoration service, on quotation.
9. Liability
Our liability is limited to cases of intent or gross negligence. We accept no liability for indirect damage.
Precious metal and enamel jewelry is delicate: we recommend that you wear it with care and insure it.
10. Data Protection
We process your personal data in accordance with the Swiss Federal Act on Data Protection (FADP) and, for customers in the European Union, the General Data Protection Regulation (GDPR). Please see our Privacy Policy on the Site.
11. Intellectual Property
The Eclats d’Email trademark, its logo and the visuals on the Site are protected. Any reproduction without authorization is prohibited.
12. Governing Law and Jurisdiction
These Terms are governed by Swiss law, excluding its conflict-of-law rules.
Any dispute shall be submitted to the ordinary courts at the registered office of Eclats d’Email SA in Marsens (Canton of Fribourg), subject to any mandatory consumer protection rules applicable in your country of residence.
In the event of any discrepancy between language versions, the French version shall prevail.
